Notification of Enforcement Discretion for Telehealth Remote Communications During the COVID-19 Nationwide Public Health Emergency
Discusses the enforcement discretion that the HHS Office of Civil Rights (OCR) will use during to the COVID-19 nationwide public health emergency related to Health Insurance Portability and Accountability Act of 1996 (HIPAA) requirements. Explains that OCR will not impose penalties for noncompliance with the regulatory requirements under the HIPAA Rules against covered healthcare providers in connection with the good faith provision of telehealth during the public health emergency. Identifies applications that can be used and those that should not be used.
